You must have the legal capacity to enter into a binding agreement to purchase paid Services.

Many Sell The Job products and services are designed for contractors, roofing companies, restoration companies, public adjusters, sales professionals, home-service companies, construction businesses, insurance professionals, and other commercial users.

You are responsible for determining whether a particular product or service is appropriate and lawful for your business, profession, licensing status, activities, and jurisdiction.

Nothing offered through Sell The Job authorizes you to engage in an activity for which a professional license, registration, permit, appointment, certification, or other governmental authorization is legally required.

3. AUTHORITY TO BIND A BUSINESS

If you create an account, submit an order, purchase Services, electronically accept these Terms, or otherwise act on behalf of a corporation, limited liability company, partnership, employer, contractor, or other organization, you represent and warrant that you have authority to act for and bind that organization with respect to the transaction.

Where you purchase on behalf of an organization, references to “you,” “your,” or “customer” include the organization where appropriate.

If you do not have authority to bind an organization, you may not represent that you do.

The organization may be responsible for purchases, accounts, licenses, and Services obtained by an authorized representative acting within the scope of that representative’s actual or apparent authority, subject to applicable law.

4. ELECTRONIC ACCEPTANCE, SIGNATURES, AND RECORDS

You agree that electronic acceptance may constitute a legally binding signature and agreement to the extent permitted by applicable law.

Electronic acceptance may include:

  • Checking an “I Agree” box;

  • Clicking an acceptance button;

  • Electronically signing an agreement;

  • Completing checkout after being presented with applicable terms;

  • Creating an account after being presented with applicable terms; or

  • Otherwise electronically indicating acceptance.

You consent to receiving and maintaining records electronically where permitted by law.

Sell The Job may maintain transaction records including:

  • Applicable supplier policies; and

  • Other information reasonably necessary to document the transaction.

Electronic records may be used to establish the terms applicable to a transaction, subject to applicable law.

5. MEMBER ACCOUNTS

Certain Services may require a Sell The Job member account.

You agree to provide accurate, complete, and current information when creating and maintaining an account.

You are responsible for:

  • Maintaining the confidentiality of login credentials;

  • Restricting unauthorized access to your account;

  • Activity conducted through your account by authorized users; and

  • Promptly notifying Sell The Job if you reasonably believe the account has been compromised.

You may not knowingly provide false account information, impersonate another person, or create an account for fraudulent or unlawful purposes.

Sell The Job may temporarily restrict or suspend an account when reasonably necessary to investigate:

  • Suspected fraud;

  • Unauthorized access;

  • Security incidents;

  • Credential sharing;

  • Piracy;

  • Payment disputes;

  • Abuse of the Services; or

  • Material violations of these Terms.

Account creation does not transfer ownership of any Sell The Job website, platform, course, content, document, or other intellectual property.

6. ORDERS AND ORDER ACCEPTANCE

Submitting an order or payment does not obligate Sell The Job or an applicable supplier to fulfill an order that cannot reasonably or lawfully be fulfilled.

Sell The Job may reject or cancel an order before fulfillment because of circumstances including:

  • Pricing errors;

  • Listing errors;

  • Payment failure;

  • Suspected fraud;

  • Product unavailability;

  • Service unavailability;

  • Territory unavailability;

  • Materially inaccurate customer information;

  • Supplier inability to perform;

  • Legal or regulatory restrictions; or

  • Other circumstances preventing lawful or reasonable fulfillment.

An automated order confirmation or payment acknowledgment does not prevent Sell The Job from correcting an obvious error or rejecting an order that cannot lawfully or reasonably be fulfilled.

If Sell The Job itself cancels an order before any product or service has been provided because the order cannot be fulfilled, the transaction will be handled in accordance with applicable law.

7. PRICING, PAYMENT, AND TAXES

Unless otherwise indicated, prices are stated in United States dollars.

You agree to pay all charges applicable to your purchase, which may include:

  • Product prices;

  • Service fees;

  • Setup fees;

  • Campaign fees;

  • Appointment charges;

  • Shipping charges;

  • Taxes;

  • Success fees;

  • Recurring charges;

  • Customization charges; and

  • Other clearly disclosed charges.

You represent that you are authorized to use any payment method submitted to Sell The Job.

You authorize Sell The Job and its applicable payment processors to process the charges associated with your authorized transaction.

Sell The Job may collect and remit applicable taxes where legally required.

Except where applicable law provides otherwise, you remain responsible for taxes arising from your purchases or business activities other than taxes imposed directly upon Sell The Job’s income.

8. PRICING, TYPOGRAPHICAL, AND TECHNICAL ERRORS

Sell The Job attempts to maintain accurate product descriptions, pricing, discounts, and website information.

However, typographical, technical, publishing, pricing, configuration, or other inadvertent errors may occur.

To the extent permitted by applicable law, Sell The Job reserves the right to:

  • Correct an obvious error;

  • Update inaccurate information;

  • Correct an incorrect price;

  • Reject an affected unfulfilled order; or

  • Cancel an affected unfulfilled transaction.

Sell The Job is not required to provide a product or service at a price that was clearly displayed because of an obvious technical, typographical, or publishing error where applicable law permits correction.

If an error is discovered after payment but before fulfillment, Sell The Job may contact the customer regarding the corrected terms or otherwise handle the transaction in accordance with applicable law.

9. PROMOTIONS, DISCOUNTS, AND COUPONS

Promotional offers, discounts, coupons, credits, special pricing, package pricing, and limited-time offers may contain additional conditions.

Unless expressly stated otherwise:

  • Discounts have no cash value;

  • Discounts are non-transferable;

  • Discounts cannot be redeemed for cash;

  • Multiple promotions may not be combined;

  • Promotions may have expiration dates;

  • Promotions may be restricted to particular products, customers, territories, quantities, or time periods;

  • A promotional price does not establish the future price of a product or service; and

  • Sell The Job may reject fraudulent, duplicated, manipulated, or unauthorized promotional use.

Expiration or non-use of a promotion does not create a right to a refund.

Sell The Job may discontinue or modify a promotion prospectively, subject to honoring transactions already accepted where required by applicable law.

10. ALL SALES ARE FINAL — NO REFUNDS, NO CANCELLATIONS, NO RETURNS

ALL SALES ARE FINAL TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Once an order or payment has been submitted and accepted:

NO REFUNDS.
NO CANCELLATIONS.
NO RETURNS.

There are also no exchanges unless Sell The Job expressly agrees otherwise in writing or applicable law requires otherwise.

This policy applies to all products and services, including:

  • Books;

  • eBooks;

  • Digital products;

  • Downloads;

  • Sell The Job University;

  • Training courses;

  • Educational programs;

  • Training materials;

  • Sales programs;

  • Forms;

  • Contracts;

  • Templates;

  • Scope sheets;

  • Customized documents;

  • Custom-branded materials;

  • Custom videos;

  • Product packages and bundles;

  • Setup fees;

  • Campaign fees;

  • Appointment packages;

  • Individual appointments;

  • Prepaid appointments;

  • Pay-as-you-go appointment programs;

  • Remote sales services;

  • Answering services;

  • Customer-support services;

  • Call-center services;

  • Application fees;

  • Partner products;

  • Third-party services; and

  • Other products and services offered through Sell The Job.

A customer’s decision not to use a purchased product or service does not create a right to a refund.

A customer’s failure to download, access, implement, complete, attend, deploy, or otherwise use a purchased product or service does not create a refund right.

Changes in your business, finances, staffing, territory, sales capacity, production capacity, marketing plans, personal circumstances, or ability to use a purchased product or service do not create a right to cancel an accepted purchase.

For appointment services, an approved supplier credit or replacement does not constitute a cash refund unless the applicable supplier expressly provides otherwise.

Nothing in this section eliminates any non-waivable consumer right or remedy required by applicable law.

11. DIGITAL PRODUCTS AND DOWNLOADS

Digital products may be delivered through:

  • Email;

  • Download links;

  • Member accounts;

  • Online access;

  • Private webpages;

  • Sell The Job University; or

  • Another electronic delivery method.

Once digital content has been delivered or made available, the sale remains final except where applicable law requires otherwise.

You are responsible for downloading and securely storing purchased content where downloading is permitted.

Download links may expire or contain reasonable technical, access, copying, or security restrictions.

The expiration of a download link does not transfer ownership of the product or expand the customer’s license.

Purchasing digital content grants only the applicable right or license to use the product. It does not transfer ownership of Sell The Job’s underlying intellectual property.

12. MEMBER LOGIN, PRIVATE PAGES, SELL THE JOB UNIVERSITY, AND TRAINING COURSES

Sell The Job may provide customers, members, students, sales representatives, contractors, business owners, or other authorized users with access to password-protected member pages, educational content, and online training programs, including Sell The Job University.

  • Coaching materials;

  • Continuing training;

  • Private member content; and

  • Other educational or business resources.

Access to member pages and training materials is provided solely to authorized users and remains subject to these Terms.

Access to a member area does not make protected materials public information and does not grant permission to copy, redistribute, reproduce, resell, publish, or commercially exploit those materials.

13. PERSONAL AND AUTHORIZED MEMBER ACCESS

Unless Sell The Job expressly provides a multi-user, company, team, or enterprise license, a member account is for one authorized user.

You may not:

  • Share your username or password;

  • Permit another person to log in using your account;

  • Sell, rent, transfer, or sublicense your account;

  • Publish login credentials;

  • Provide unauthorized employees, contractors, representatives, friends, family members, or third parties with access;

  • Use a single-user account to train multiple unauthorized users;

  • Circumvent user, device, seat, session, or access limitations;

  • Create accounts using materially false information;

  • Access another member’s account without authorization; or

  • Assist another person in obtaining unauthorized access.

Where a company purchases multiple-user or team access, access remains limited to the number of users, seats, representatives, or licenses included in that purchase.

The purchasing company is responsible for ensuring that its authorized users comply with these Terms.

Membership, University access, and account credentials may not be transferred to an unrelated person or company without Sell The Job’s written authorization.

14. SELL THE JOB UNIVERSITY LICENSE

Access to Sell The Job University constitutes a limited, revocable, non-exclusive, non-transferable license to access and use applicable training materials for authorized educational and internal business purposes.

Purchasing or receiving access to Sell The Job University does not transfer ownership of:

  • The Sell The Job sales system;

  • Course content;

  • Training methods as expressed in protected course materials;

  • Training videos;

  • Presentations;

  • Scripts;

  • Manuals;

  • Written materials;

  • Graphics;

  • Downloads;

  • Training documents;

  • Course organization;

  • Proprietary processes embodied in protected materials; or

  • Other Sell The Job intellectual property.

All rights not expressly granted remain reserved by J & J Investments of Florida LLC d/b/a Sell The Job or the applicable rights holder.

You may apply knowledge and skills legitimately learned through the training in your own authorized sales and business activities.

That right does not authorize you to copy, reproduce, redistribute, republish, or create unauthorized commercial reproductions of Sell The Job’s protected training materials.

15. UNIVERSITY AND TRAINING COURSE SALES ARE FINAL

Purchases of Sell The Job University access, online training, courses, educational programs, memberships, orientations, coaching materials, and other digital training products are subject to the All Sales Final provisions contained in Section 10.

To the maximum extent permitted by applicable law:

NO REFUNDS.
NO CANCELLATIONS.
NO RETURNS.

A member’s failure to:

  • Log in;

  • Begin a course;

  • Complete a course;

  • Watch training videos;

  • Attend available training;

  • Download available materials;

  • Use the training;

  • Implement the sales system;

  • Complete quizzes or assessments; or

  • Achieve a desired result

does not create a right to a refund.

Access to educational materials does not guarantee any particular sales, employment, income, licensing, certification, revenue, closing-rate, or business result.

16. NO RECORDING, COPYING, DOWNLOADING, OR REPRODUCING TRAINING

Except where Sell The Job expressly provides a downloadable resource or gives written authorization, members may not record, download, capture, reproduce, copy, duplicate, republish, distribute, or otherwise reproduce Sell The Job University or other protected member content.

You may not:

  • Screen-record courses;

  • Record training videos;

  • Record audio from training;

  • Download streaming videos through unauthorized methods;

  • Screenshot substantial portions of courses for redistribution;

  • Copy course text for unauthorized use or distribution;

  • Transcribe courses for redistribution;

  • Reproduce training presentations;

  • Copy or recreate course modules;

  • Duplicate manuals or proprietary training materials for unauthorized users;

  • Upload course content to another website, learning platform, cloud repository intended for sharing, or training system;

  • Post protected training content on YouTube, social media, file-sharing platforms, forums, groups, or similar services;

  • Sell, license, rent, or give protected training materials to another person or business;

  • Share restricted download links;

  • Share protected files with unauthorized users;

  • Circumvent technological measures intended to restrict downloading, copying, recording, or access; or

  • Otherwise reproduce protected training content outside the scope of the license granted by Sell The Job.

Materials specifically identified as downloadable may be downloaded and used according to the license and intended purpose accompanying those materials.

Authorization to download a particular resource does not authorize redistribution, resale, publication, sublicensing, or creation of competing products from that resource.

17. NO RECREATION OR COMPETING TRAINING PROGRAM

Sell The Job University and its courses may contain proprietary educational content, organization, presentations, materials, documents, and intellectual property.

You may apply the knowledge and skills you legitimately learn through Sell The Job training in your own sales and business activities.

However, purchasing, accessing, or completing a course does not authorize you to reproduce the training itself.

You may not substantially copy, duplicate, or recreate protected Sell The Job University materials for the purpose of:

  • Creating a competing training course;

  • Creating a substantially copied membership program;

  • Selling copied or substantially reproduced training materials;

  • Licensing copied training materials;

  • Conducting unauthorized paid training using Sell The Job’s protected materials;

  • Creating a competing membership website using copied Sell The Job content;

  • Creating a substantially copied book or eBook;

  • Creating a substantially copied training manual;

  • Creating a substantially copied video series;

  • Creating a substantially copied seminar or webinar;

  • Creating a substantially copied digital course;

  • Repackaging Sell The Job materials under another brand or business name; or

  • Distributing Sell The Job’s protected materials as though they were independently created.

Nothing in this section is intended to claim ownership over general knowledge, ideas, facts, skills, or methods that are not legally protectable. This section applies to Sell The Job’s protected expression, materials, content, contractual-use restrictions, and other legally protectable rights.

18. COMPANY, TEAM, AND ENTERPRISE TRAINING LICENSES

If a business purchases a team, company, multi-user, or enterprise training package, the number of authorized users and permitted scope of use will be determined by the applicable:

  • Product description;

  • Order;

  • Invoice;

  • License;

  • Written agreement; or

  • Other written purchase terms.

A company license does not automatically authorize unlimited users.

Unless expressly included in the applicable purchase, additional:

  • Employees;

  • Sales representatives;

  • Independent contractors;

  • Managers;

  • Offices;

  • Branches;

  • Locations;

  • Affiliated companies; or

  • Other users

may require additional licenses or seats.

The purchasing organization is responsible for ensuring its authorized users comply with these Terms.

Access may not be transferred to an unrelated business or person without Sell The Job’s written authorization.

If an authorized user leaves the purchasing company, reassignment of that user’s seat is subject to the applicable license terms and any reasonable account-security procedures established by Sell The Job.

19. MEMBER CONTENT AND COURSE AVAILABILITY

Sell The Job may periodically update, improve, revise, replace, reorganize, add, or remove educational materials in order to maintain or improve its training programs.

Changes may include:

  • Updating training videos;

  • Replacing outdated videos;

  • Revising course modules;

  • Adding new modules;

  • Removing outdated information;

  • Updating downloads;

  • Modifying course organization;

  • Changing instructors or presenters;

  • Updating member interfaces;

  • Changing technology providers;

  • Migrating content between platforms; or

  • Making other reasonable improvements.

Unless a product is expressly sold with guaranteed lifetime access, purchasing a course does not create a perpetual obligation for Sell The Job to maintain a particular:

  • Website;

  • Technology platform;

  • Video;

  • Instructor;

  • Module;

  • Download;

  • Interface;

  • Course format; or

  • Version of the training

indefinitely.

Any specifically advertised access period applicable to the purchased product will control.

Sell The Job may replace outdated training with updated or substantially equivalent material where appropriate.

20. TEMPORARY TECHNICAL INTERRUPTIONS

Sell The Job does not guarantee that member pages, Sell The Job University, downloads, or online Services will be continuously available without interruption.

Temporary interruptions may occur because of circumstances including:

  • Website maintenance;

  • Platform maintenance;

  • Software updates;

  • Hosting problems;

  • Internet outages;

  • Telecommunications failures;

  • Cybersecurity events;

  • Third-party provider outages;

  • System upgrades;

  • Emergency maintenance; or

  • Circumstances outside Sell The Job’s reasonable control.

A temporary technical interruption does not automatically create a right to a refund, cancellation, extension, or other monetary compensation.

If a technical problem prevents legitimate access, the member should contact Sell The Job so that reasonable efforts can be made to investigate and restore access.

Where an advertised fixed access period is materially affected by an extended interruption attributable to Sell The Job, Sell The Job may provide an appropriate access extension or other remedy where required by applicable law or determined appropriate under the circumstances.

21. MEMBER ACCOUNT SECURITY AND LICENSE ENFORCEMENT

To protect customers, member accounts, intellectual property, licensing restrictions, and the security of the Services, Sell The Job may use reasonable technical and security information consistent with its Privacy Policy and applicable law.

Such information may include:

  • Login activity;

  • Session activity;

  • IP address information;

  • Device information;

  • Browser information;

  • Concurrent login information;

  • Download activity;

  • Access history;

  • Authentication activity; and

  • Security events.

Sell The Job may use such information for purposes including:

  • Protecting member accounts;

  • Identifying unauthorized access;

  • Investigating credential sharing;

  • Enforcing authorized seat limits;

  • Investigating piracy;

  • Detecting fraudulent activity;

  • Protecting digital content;

  • Preventing unauthorized downloads;

  • Identifying excessive or suspicious concurrent access; and

  • Investigating material violations of these Terms.

The collection and use of personal information remain subject to the Sell The Job Privacy Policy and applicable law.

22. SUSPENSION OR TERMINATION OF MEMBER ACCESS

Sell The Job may suspend, restrict, or terminate member access when it reasonably determines that an account is being used in material violation of these Terms.

Grounds may include:

  • Credential sharing;

  • Unauthorized account access;

  • Course piracy;

  • Unauthorized copying;

  • Unauthorized distribution;

  • Copyright infringement;

  • Trademark infringement;

  • Fraud;

  • Fraudulent payment activity;

  • Circumvention of security controls;

  • Unauthorized resale;

  • Unauthorized reproduction of documents;

  • Unauthorized reproduction of training;

  • Systematic scraping or extraction of protected content;

  • Creation of competing products through unauthorized copying; or

  • Other material misuse of the Services.

Where appropriate, Sell The Job may investigate suspected violations before terminating access.

Sell The Job may take reasonable steps to preserve evidence of suspected violations.

Termination or suspension resulting from a customer’s material violation of these Terms does not create a right to a refund except where applicable law requires otherwise.

Sell The Job reserves all intellectual-property, contractual, and other remedies available under applicable law.

23. SALES TRAINING RESULTS

Sell The Job University and other Sell The Job training programs are educational and business-training resources.

Completion of training does not guarantee:

  • Employment;

  • A job offer;

  • Professional licensing;

  • Government certification;

  • Sales;

  • Contracts;

  • Leads;

  • Appointments;

  • Income;

  • Commissions;

  • Closing percentages;

  • Revenue;

  • Profit;

  • Business growth;

  • Business success; or

  • Any particular financial result.

Individual results may depend upon numerous factors, including:

  • Experience;

  • Effort;

  • Implementation;

  • Communication skills;

  • Sales ability;

  • Market conditions;

  • Territory;

  • Competition;

  • Company operations;

  • Pricing;

  • Customer demand;

  • Follow-up;

  • Available opportunities; and

  • Other circumstances outside Sell The Job’s control.

Testimonials, examples, illustrations, sales scenarios, and discussions of potential performance do not constitute guarantees of future results.

24. CERTIFICATES AND COURSE COMPLETION

Sell The Job may provide course-completion certificates, badges, acknowledgments, or similar recognition for certain training programs.

Unless expressly stated otherwise, a Sell The Job certificate represents completion of the applicable Sell The Job training program only.

A Sell The Job certificate does not constitute:

  • A government license;

  • A professional license;

  • State certification;

  • Government accreditation;

  • Insurance licensing;

  • Public-adjuster licensing;

  • Contractor licensing;

  • Authority to perform regulated activities;

  • A guarantee of professional competency; or

  • A guarantee of sales or financial performance.

Users remain responsible for obtaining any license, registration, certification, insurance, appointment, permit, or professional qualification required by applicable law.

Sell The Job may establish reasonable requirements for earning or maintaining a particular course-completion designation.

25. MEMBER RESPONSIBILITY

Members are responsible for maintaining:

  • A compatible device;

  • Reliable Internet access;

  • A valid email address;

  • Accurate account information;

  • Secure login credentials;

  • Appropriate software reasonably necessary to access online content; and

  • Compliance with applicable member and licensing restrictions.

Members should contact Sell The Job if they experience a legitimate account-access problem.

Sell The Job is not responsible for inability to access content caused solely by a member’s unsupported equipment, unavailable Internet connection, forgotten credentials, disabled email account, or other condition outside Sell The Job’s reasonable control.

26. CUSTOMIZED PRODUCTS AND CUSTOMER-SUPPLIED MATERIALS

Sell The Job may customize products using information or materials supplied by a customer, including:

  • Company names;

  • Logos;

  • Branding;

  • Addresses;

  • Contact information;

  • Licensing information;

  • Service information;

  • Territory information;

  • Custom language;

  • Photographs;

  • Videos;

  • Graphics;

  • Trademarks; and

  • Other customer-provided content.

You are responsible for ensuring that information submitted for customization is accurate.

You represent and warrant that you own, control, or possess sufficient rights, licenses, consents, and permissions to provide any logo, photograph, video, graphic, trademark, text, or other material you submit to Sell The Job for the requested purpose.

You grant Sell The Job a limited, non-exclusive license to use, reproduce, modify, resize, format, adapt, and incorporate customer-supplied materials solely as reasonably necessary to:

  • Create the purchased product;

  • Perform the requested Service;

  • Fulfill the applicable transaction;

  • Provide customer support;

  • Maintain reasonable business and transaction records; or

  • Perform another purpose expressly authorized by you.

Unless separately authorized, this limited operational license does not automatically grant Sell The Job permission to use your company’s name, logo, testimonial, customer information, results, or completed custom materials in unrelated public advertising.

Customized products are final-sale products to the maximum extent permitted by applicable law.

Once customization or production work has begun, a customer’s decision to change branding, information, strategy, personnel, or intended use does not create a right to cancel or obtain a refund.

27. THIRD-PARTY PRODUCTS AND SERVICES

Sell The Job may market, facilitate, resell, refer, bundle, or provide access to products and services supplied or fulfilled by affiliated or independent third parties.

A third-party product or service may be governed by:

  1. These Sell The Job Terms;

  2. The applicable product description;

  3. The applicable order or invoice;

  4. A separate written service agreement, if applicable; and

  5. The supplier’s applicable terms, conditions, qualification standards, guarantees, credit policies, documentation requirements, and replacement procedures.

Where a supplier’s terms specifically govern qualification, performance, appointment credits, replacements, or fulfillment of that supplier’s service, the applicable supplier terms govern those matters.

Purchasing a third-party product through Sell The Job does not make Sell The Job the provider of every underlying service performed independently by that third party.

Sell The Job is not responsible for independent acts or omissions of a third-party provider except to the extent responsibility is imposed by applicable law or expressly assumed in writing by Sell The Job.

28. APPOINTMENT-GENERATION SERVICES

Sell The Job may offer appointment-generation products supplied by Sell The Job, affiliated companies, or independent suppliers.

An appointment generally represents a scheduled opportunity for the purchasing company or its representative to meet or communicate with a prospective customer for purposes specified by the applicable campaign.

Depending upon the product, the opportunity may involve:

  • Inspecting a property;

  • Presenting services;

  • Providing an estimate;

  • Discussing a project;

  • Evaluating customer needs;

  • Discussing roofing services;

  • Discussing restoration services;

  • Discussing a specialty trade or professional service; or

  • Performing another activity specified by the campaign.

AN APPOINTMENT IS A SALES OR BUSINESS OPPORTUNITY. IT IS NOT A GUARANTEED SALE.

Unless expressly provided in a separate written guarantee applicable to the particular transaction, Sell The Job and its suppliers do not guarantee:

  • A sale;

  • A signed contract;

  • A contingency agreement;

  • A retail agreement;

  • An insurance claim;

  • Insurance coverage;

  • Insurance claim approval;

  • Financing approval;

  • Property damage;

  • Storm damage;

  • Project value;

  • Revenue;

  • Profit;

  • Commission;

  • Return on investment; or

  • A particular closing percentage.

The purchasing company remains responsible for its own:

  • Sales presentation;

  • Representative performance;

  • Inspections;

  • Estimates;

  • Pricing;

  • Follow-up;

  • Contracting;

  • Licensing;

  • Customer service;

  • Workmanship; and

  • Customer relationships.

An appointment may satisfy the applicable qualification criteria even if the customer ultimately does not purchase the purchasing company’s services.

29. APPOINTMENT SUPPLIER TERMS AND CREDIT POLICIES

ALL APPOINTMENTS PURCHASED THROUGH SELL THE JOB ARE SUBJECT TO THE TERMS, CONDITIONS, QUALIFICATION STANDARDS, GUARANTEE TERMS, CREDIT POLICIES, DOCUMENTATION REQUIREMENTS, REPORTING DEADLINES, AND REPLACEMENT PROCEDURES OF THE SUPPLIER PROVIDING THE APPOINTMENT.

This is a material condition of every appointment purchase.

Sell The Job’s All Sales Final / No Refunds / No Cancellations / No Returns policy is separate from a supplier’s appointment-credit or replacement program.

Unless the applicable supplier expressly states otherwise, an appointment credit means a replacement appointment or service/account credit—not a cash refund.

Customers are responsible for reviewing and complying with applicable supplier requirements.

Depending upon the supplier and campaign, those requirements may include:

  • Credit submission deadlines;

  • Appointment outcome reporting;

  • Photographs;

  • Property photographs;

  • Representative photographs or selfies;

  • Date and time verification;

  • Location verification;

  • Call recordings;

  • Written documentation;

  • Representative attendance;

  • Timely arrival;

  • Inspection requirements;

  • Presentation requirements;

  • Customer communications;

  • Disposition reporting; and

  • Other evidence required by the applicable supplier.

Failure to comply with an applicable supplier’s documentation, reporting, attendance, or submission requirements may result in denial of the requested credit or replacement.

Submitting a credit request does not mean that the request has been approved.

Credit eligibility is determined under the applicable supplier policy.

30. ROOFING APPOINTMENTS CREDIT POLICY

Appointments supplied or fulfilled by Roofing Appointments are subject to Roofing Appointments’ applicable:

  • Qualification requirements;

  • Guarantee terms;

  • Credit eligibility requirements;

  • Documentation requirements;

  • Reporting requirements;

  • Submission deadlines;

  • Review procedures; and

  • Replacement procedures.

The applicable credit policy is available here:

Roofing Appointments Credit Policy

By purchasing an appointment supplied or fulfilled by Roofing Appointments through Sell The Job, you acknowledge and agree that credit or replacement eligibility will be determined under the applicable Roofing Appointments policy, subject to applicable law.

A disputed appointment does not automatically qualify for a credit or replacement.

Submission of a credit request does not suspend the customer’s obligations relating to other appointments or payments unless the applicable written agreement expressly provides otherwise.

An approved Roofing Appointments credit is governed by the applicable supplier policy and does not constitute a cash refund unless expressly stated otherwise by the supplier or required by applicable law.

31. STORM911 CREDIT POLICY

Appointments supplied or fulfilled by Storm911 are subject to Storm911’s applicable:

  • Qualification requirements;

  • Guarantee terms;

  • Credit eligibility requirements;

  • Documentation requirements;

  • Reporting requirements;

  • Submission deadlines;

  • Review procedures; and

  • Replacement procedures.

The applicable credit policy is available here:

Storm911 Credit Policy

By purchasing an appointment supplied or fulfilled by Storm911 through Sell The Job, you acknowledge and agree that credit or replacement eligibility will be determined under the applicable Storm911 policy, subject to applicable law.

A disputed appointment does not automatically qualify for a credit or replacement.

Submission of a credit request does not suspend the customer’s obligations relating to other appointments or payments unless the applicable written agreement expressly provides otherwise.

An approved Storm911 credit is governed by the applicable supplier policy and does not constitute a cash refund unless expressly stated otherwise by the supplier or required by applicable law.

32. APPOINTMENT CREDITS ARE NOT CASH REFUNDS

Unless expressly stated otherwise in writing by the applicable supplier or required by applicable law, an approved appointment credit constitutes a replacement appointment or account/service credit.

AN APPROVED APPOINTMENT CREDIT DOES NOT CONSTITUTE A CASH REFUND.

An appointment credit does not:

  • Reverse the original sale;

  • Cancel the underlying purchase;

  • Require the original payment to be returned;

  • Create a right to cancel the remaining appointment package;

  • Convert a prepaid package into a refundable transaction;

  • Eliminate amounts otherwise owed under an applicable agreement; or

  • Automatically entitle the customer to select a different service or product.

The applicable supplier determines whether an appointment qualifies for credit or replacement under its applicable policy.

A customer may not unilaterally convert a disputed appointment into a monetary deduction, refund, chargeback, or offset against amounts otherwise owed unless authorized by the applicable agreement or required by law.

33. CUSTOMER RESPONSIBILITIES FOR APPOINTMENTS

Customers are responsible for ensuring that their owners, managers, employees, sales representatives, independent contractors, public adjusters, estimators, inspectors, or other representatives properly handle appointments supplied through Sell The Job or an applicable supplier.

Customers are responsible for ensuring their representatives:

  • Attend appointments as scheduled;

  • Arrive on time;

  • Maintain reasonable communication with the prospective customer;

  • Contact prospective customers appropriately;

  • Conduct applicable inspections;

  • Provide applicable presentations;

  • Provide estimates when applicable;

  • Behave professionally;

  • Follow applicable supplier procedures;

  • Accurately report appointment outcomes;

  • Submit credit requests within applicable deadlines;

  • Maintain required supporting documentation;

  • Comply with licensing requirements; and

  • Comply with applicable law.

Failure by the customer or its representative to properly attend, inspect, present, estimate, communicate, follow up, or otherwise perform does not create a right to a refund.

A customer’s inability to close a sale does not establish that an appointment was invalid.

34. CAMPAIGN PRODUCTION, DELIVERY, AND TERRITORIES

Appointment production and delivery may vary based upon factors including:

  • Geography;

  • Population;

  • Market conditions;

  • Territory size;

  • Property density;

  • Qualification criteria;

  • Data availability;

  • Data quality;

  • Weather;

  • Seasonality;

  • Calling conditions;

  • Consumer response rates;

  • Customer scheduling availability;

  • Representative availability;

  • Regulatory requirements;

  • Campaign restrictions;

  • Supplier capacity;

  • Holidays; and

  • Other operational factors.

Unless a specific production deadline is expressly guaranteed in a written agreement applicable to the transaction, statements concerning expected production periods are estimates and not guarantees of completion by a particular date.

Purchasing a particular number of appointments does not, by itself, mean every appointment will be produced or delivered within a particular number of calendar or business days.

Customer-requested changes to:

  • Territory;

  • ZIP codes;

  • Radius;

  • Qualification criteria;

  • Services;

  • Scheduling;

  • Appointment availability;

  • Staffing;

  • Representative capacity; or

  • Other campaign requirements

may affect production or delivery.

35. CAMPAIGN PAUSES, CUSTOMER DELAYS, AND INACTIVITY

Customers purchasing appointment services are responsible for maintaining reasonable availability and capacity to receive the Services they purchased.

Production may be delayed, reduced, or paused when a customer:

  • Requests a campaign hold;

  • Requests production to stop;

  • Has insufficient representatives;

  • Repeatedly refuses otherwise qualifying appointment times;

  • Becomes unreachable;

  • Fails to respond to campaign communications;

  • Fails to provide required campaign information;

  • Fails to maintain appointment availability;

  • Requests material territory changes;

  • Requests material qualification changes;

  • Changes its services during production; or

  • Otherwise prevents reasonable fulfillment.

Customer-caused delays do not create a right to a refund or cancellation.

Any specific expiration, inactivity, campaign-hold, restart, reactivation, or production requirements contained in the applicable product description, supplier policy, invoice, or service agreement also apply.

Sell The Job and the applicable supplier are not required to maintain dedicated production capacity indefinitely for a customer who voluntarily pauses or prevents production.

36. WEATHER, HAIL, PROPERTY, AND THIRD-PARTY DATA

Certain Services may include information supplied by third parties, including:

  • Hail maps;

  • Weather reports;

  • Storm histories;

  • Property records;

  • Aerial measurements;

  • Roof diagrams;

  • Satellite or aerial imagery;

  • Property information;

  • Ownership information;

  • Contact information;

  • Telephone data;

  • Email data; and

  • Other third-party information.

Third-party information may contain errors, estimates, omissions, inaccuracies, or delays.

Sell The Job does not guarantee the accuracy, completeness, or current status of independently supplied third-party data.

A hail report, weather report, storm history, or storm map does not establish or guarantee that:

  • A particular property sustained damage;

  • Damage occurred on a particular date;

  • Damage is covered by insurance;

  • An insurance carrier will approve a claim;

  • A property owner will file a claim; or

  • A project will result from the appointment.

Aerial roof diagrams and measurements are supporting resources and should be independently verified where accuracy is material to estimating, ordering, construction, or contracting.

37. PUBLIC ADJUSTER, INSURANCE, AND OTHER REGULATED ACTIVITIES

Some Sell The Job products and Services may be purchased or used by:

  • Public adjusters;

  • Insurance professionals;

  • Roofing contractors;

  • Restoration contractors;

  • General contractors;

  • Specialty contractors;

  • Sales representatives; or

  • Other regulated businesses or professionals.

Sell The Job does not grant professional licenses and does not authorize any person to perform activities that legally require a license, registration, appointment, certification, permit, or other governmental authorization.

Customers are solely responsible for maintaining all required:

  • Licenses;

  • Registrations;

  • Appointments;

  • Permits;

  • Insurance;

  • Professional qualifications;

  • Business authorizations; and

  • Legal authority.

Public adjusting, insurance solicitation, insurance sales, contracting, legal advice, financial advice, or other regulated activities must be performed only by appropriately authorized persons where required.

Appointment generation, lead qualification, administrative support, or scheduling does not by itself authorize an unlicensed person to engage in regulated activity.

38. FORMS, CONTRACTS, TEMPLATES, AND BUSINESS DOCUMENTS

Sell The Job offers forms, contracts, agreements, templates, scope sheets, SOPs, checklists, notices, authorizations, and other business documents.

These materials are intended as business resources and do not constitute legal advice.

Laws governing matters such as:

  • Construction contracts;

  • Roofing contracts;

  • Home-improvement contracts;

  • Insurance restoration;

  • Assignments of benefits;

  • Direction-to-pay documents;

  • Cancellation rights;

  • Notices of cancellation;

  • Independent contractors;

  • Employment relationships;

  • Commissions;

  • Wage deductions;

  • Consumer transactions;

  • Licensing;

  • Required disclosures;

  • Electronic signatures; and

  • Other contractual requirements

vary by state, locality, industry, and circumstance.

You are responsible for determining whether a document is appropriate for your intended use and for having documents reviewed by qualified legal counsel where appropriate.

Customization by Sell The Job does not constitute legal advice and does not guarantee that a document complies with every law, regulation, ordinance, licensing rule, disclosure requirement, or contractual requirement applicable to your business.

A customer’s purchase or use of a form does not create an attorney-client relationship with Sell The Job.

39. INDEPENDENT CONTRACTOR DOCUMENTS

Sell The Job may provide agreements and forms intended for relationships involving sales representatives, production managers, sales managers, or other independent contractors.

A document labeled an “Independent Contractor Agreement” does not, by itself, legally establish independent-contractor status.

Worker classification depends upon the actual facts and circumstances of the relationship and applicable law.

Customers are responsible for obtaining appropriate professional advice concerning:

  • Worker classification;

  • Employment law;

  • Compensation;

  • Commissions;

  • Draws;

  • Wage deductions;

  • Payroll;

  • Taxes;

  • Workers’ compensation;

  • Unemployment obligations;

  • Insurance;

  • Benefits;

  • Recordkeeping; and

  • Other employment or contractor requirements.

Sell The Job does not guarantee that use of an independent-contractor document will cause a worker to be classified as an independent contractor by a court, agency, taxing authority, or other governmental body.

40. EDUCATIONAL AND SALES TRAINING DISCLAIMER

Sell The Job provides sales training, books, educational materials, techniques, strategies, systems, scripts, presentations, and other business resources intended to improve knowledge and sales processes.

Individual results vary.

Sell The Job does not guarantee:

  • Sales;

  • Signed contracts;

  • Closing percentages;

  • Revenue;

  • Profit;

  • Commissions;

  • Income;

  • Employment;

  • Business growth;

  • Business success;

  • Customer acquisition; or

  • Any particular financial result.

Testimonials, examples, scenarios, projections, illustrations, case studies, and discussions of potential performance are provided for educational or illustrative purposes and do not guarantee future performance.

Past results do not guarantee future results.

The customer remains responsible for how training is implemented and for complying with all laws applicable to sales, marketing, solicitation, telemarketing, contracting, insurance, consumer protection, licensing, and other business activities.

41. REMOTE SALES AND BUSINESS SUPPORT SERVICES

Sell The Job may offer or facilitate remote sales, answering, call-center, customer-support, qualification, appointment coordination, follow-up, and related business Services.

Depending upon the applicable program, Services may include:

  • Lead or prospect qualification;

  • Customer communication;

  • Appointment scheduling;

  • Sales presentations;

  • Estimate or proposal presentations;

  • Follow-up;

  • Objection handling;

  • Customer-support communication;

  • Financing discussions where appropriately authorized;

  • Deposit coordination;

  • Administrative support; or

  • Other agreed business functions.

No particular sales, revenue, conversion, profit, or closing result is guaranteed unless expressly stated in a separate written agreement.

Unless a separate written agreement expressly provides otherwise, the customer remains responsible for its:

  • Products;

  • Services;

  • Pricing;

  • Estimates;

  • Contracts;

  • Licensing;

  • Regulatory compliance;

  • Workmanship;

  • Permits;

  • Insurance;

  • Taxes;

  • Warranties;

  • Customer satisfaction;

  • Product delivery;

  • Construction performance; and

  • Legal compliance.

Where a service involves an activity requiring professional licensing, the activity must be performed by an appropriately licensed person where required by law.

42. NO RELIANCE ON ORAL REPRESENTATIONS

The written terms applicable to a transaction control over materially inconsistent oral statements to the extent permitted by applicable law.

Customers should not rely upon an oral representation, estimate, projection, promise, guarantee, or statement that materially conflicts with:

  • These Terms;

  • The applicable product description;

  • The applicable invoice;

  • A written service agreement;

  • An applicable supplier policy;

  • An applicable written guarantee; or

  • Another written term governing the transaction.

Any material modification to a written commitment should be confirmed in writing by an authorized representative.

Sales discussions, estimates, forecasts, anticipated timelines, potential results, and informal communications do not create guarantees unless expressly incorporated into a written agreement or written guarantee applicable to the transaction.

Nothing in this section permits fraud, intentional misrepresentation, or the waiver of rights that cannot legally be waived.

43. INTELLECTUAL PROPERTY OWNERSHIP

All content and materials made available by Sell The Job are owned by, licensed to, or used with authorization by J & J Investments of Florida LLC d/b/a Sell The Job or the applicable rights holder.

Protected intellectual property may include:

  • The Sell The Job name;

  • Sell The Job University;

  • Logos;

  • Trademarks;

  • Service marks;

  • Trade dress;

  • Books;

  • eBooks;

  • Sales manuals;

  • Training systems;

  • Construction field guides;

  • Training videos;

  • Graphics;

  • Photographs;

  • Website content;

  • Advertisements;

  • Product descriptions;

  • Contracts;

  • Agreements;

  • Forms;

  • Templates;

  • Scope sheets;

  • Checklists;

  • Standard operating procedures;

  • Scripts;

  • Questionnaires;

  • Workflows;

  • Presentations;

  • Downloads;

  • Digital products;

  • Custom-branded materials;

  • Layouts;

  • Designs;

  • Course materials; and

  • Product compilations and packages.

These materials may be protected by copyright, trademark, trade-secret, unfair-competition, contractual, and other intellectual-property laws.

PURCHASING A SELL THE JOB PRODUCT DOES NOT TRANSFER OWNERSHIP OF SELL THE JOB’S UNDERLYING INTELLECTUAL PROPERTY.

You receive only the rights expressly granted by the applicable license, product description, agreement, or these Terms.

All rights not expressly granted are reserved.

44. NO DUPLICATION, RECREATION, COPYING, OR REDISTRIBUTION

Except for authorized internal business use expressly permitted under these Terms, you may not copy, duplicate, reproduce, recreate, redistribute, republish, resell, sublicense, or commercially exploit protected Sell The Job materials without written authorization.

Prohibited conduct includes:

  • Copying Sell The Job documents for resale;

  • Recreating forms, contracts, agreements, templates, scope sheets, manuals, guides, or training materials for distribution;

  • Retyping a protected document for unauthorized redistribution;

  • Redrawing or tracing protected designs;

  • Scanning protected materials for redistribution;

  • Photographing protected materials for unauthorized distribution;

  • Screenshotting materials for unauthorized distribution;

  • Removing copyright notices;

  • Removing trademark notices;

  • Removing proprietary notices;

  • Removing watermarks for unauthorized redistribution;

  • Removing Sell The Job branding for the purpose of representing protected materials as independently created;

  • Modifying a document and then selling or distributing the modified version;

  • Providing editable source files to unrelated businesses;

  • Uploading protected materials to public document-sharing services;

  • Posting protected documents in social-media groups or forums;

  • Selling or giving away unauthorized digital copies;

  • Sharing protected download links;

  • Sharing member credentials;

  • Creating a competing document package through unauthorized copying;

  • Creating substantially copied commercial products;

  • Directing another person, business, designer, developer, contractor, artificial-intelligence system, or other service to reproduce protected materials for an unauthorized purpose; or

  • Circumventing technological measures intended to restrict copying, downloading, access, or distribution.

Changing:

  • A company name;

  • Logo;

  • Font;

  • Color;

  • Layout;

  • Heading;

  • Formatting;

  • Wording;

  • File type; or

  • Other superficial characteristic

does not, by itself, authorize the reproduction or redistribution of protected Sell The Job content.

Nothing in this section restricts conduct that applicable law expressly permits and that cannot lawfully be prohibited by contract.

45. AUTHORIZED INTERNAL BUSINESS USE

Certain Sell The Job products are specifically designed to be repeatedly used within the purchasing customer’s own business.

Examples may include a purchased or custom-branded:

  • Customer contract;

  • Construction agreement;

  • Contingency agreement;

  • Build contract;

  • Construction preparation form;

  • Scope sheet;

  • Inspection form;

  • Customer notice;

  • Authorization;

  • Sales form;

  • Checklist; or

  • Other operational business document.

Where the applicable product is sold for reusable internal business use, the purchasing business may make reasonable copies and use the document within its own business for the purpose for which it was purchased.

For example, a roofing contractor purchasing a custom-branded customer agreement may print or electronically reproduce that agreement as reasonably necessary to use it with the contractor’s own customers.

This internal-use authorization does not permit the purchasing customer to:

  • Sell the underlying template;

  • Sell blank copies as a document product;

  • Give editable source files to unrelated businesses;

  • License the template to another business;

  • Publish the source file;

  • Upload the template to a public repository;

  • Create a competing document package;

  • Distribute the document as a template for third parties;

  • Remove ownership information for the purpose of unauthorized redistribution; or

  • Represent Sell The Job’s underlying intellectual property as an independently created commercial product.

The right to use an operational document within the purchasing customer’s business is separate from ownership of the underlying template, design, language, compilation, or other protected intellectual property.

Nothing in this section prohibits ordinary authorized use of lawfully purchased materials consistent with the license provided, nor does it prohibit conduct that cannot lawfully be restricted.

47. COPYRIGHT AND TRADEMARK INFRINGEMENT

Sell The Job respects intellectual-property rights and expects customers, members, visitors, vendors, and other users to do the same.

You may not use SellTheJob.co, Sell The Job University, member areas, or Sell The Job products or Services to infringe another person’s or entity’s:

  • Copyright;

  • Publicity right; or

  • Other proprietary right.

  • The protected work, mark, or other right;

  • Contact information; and

  • The basis of the infringement claim.

Sell The Job may investigate, remove, disable, or restrict access to material where appropriate and may restrict or terminate users who repeatedly or materially infringe intellectual-property rights.

Nothing in this section represents that Sell The Job has completed any particular statutory service-provider registration or designation unless such registration has actually been completed.

48. ENFORCEMENT OF INTELLECTUAL PROPERTY RIGHTS

Unauthorized copying, reproduction, recreation, redistribution, publication, resale, sublicensing, disclosure, or commercial exploitation of protected Sell The Job materials may result in:

  • Suspension of member access;

  • Termination of member access;

  • Termination of University access;

  • Removal of access to protected content;

  • Investigation of unauthorized activity; and

  • Pursuit of available contractual, legal, or equitable remedies.

Sell The Job and applicable rights holders reserve all remedies available under applicable law.

  • Injunctive relief;

  • Actual damages;

  • Statutory damages where available;

  • Recovery of unlawfully obtained profits where available;

  • Costs;

  • Attorneys’ fees where recoverable; and

  • Other available legal or equitable relief.

Sell The Job’s decision not to immediately enforce a right in one instance does not waive that right.

49. CONFIDENTIAL AND PROPRIETARY INFORMATION

Certain non-public information made available through a customer’s, supplier’s, contractor’s, reseller’s, member’s, or business partner’s relationship with Sell The Job may constitute confidential or proprietary information.

Depending upon the relationship, such information may include non-public:

  • Supplier arrangements;

  • Vendor relationships;

  • Pricing structures;

  • Wholesale pricing;

  • Business processes;

  • Campaign methodologies;

  • Internal operating procedures;

  • Sales processes;

  • Proprietary scripts;

  • Account information;

  • Dashboard information;

  • Training processes;

  • Business strategies;

  • Internal documentation;

  • Customer-specific campaign information; and

  • Other information reasonably identified or understood under the circumstances as confidential.

You may not improperly disclose, publish, sell, or commercially exploit legitimately confidential information obtained through your relationship with Sell The Job.

This restriction does not apply to information that:

  • Is lawfully available to the public through no violation by you;

  • Was lawfully known to you without confidentiality restrictions;

  • Is independently developed without use of the confidential information;

  • Is lawfully received from another source without a duty of confidentiality; or

  • Must be disclosed pursuant to applicable law, court order, subpoena, or governmental requirement.

Nothing in this section prohibits legally protected reporting to governmental or law-enforcement authorities.

50. NON-DISPARAGEMENT, FALSE STATEMENTS, AND BUSINESS REPUTATION

Customers, users, members, suppliers, vendors, contractors, and business partners may not knowingly or maliciously publish, distribute, fabricate, or promote materially false statements of fact concerning Sell The Job, J & J Investments of Florida LLC, its products, Services, owners, employees, contractors, affiliates, suppliers, or business partners.

You may not knowingly:

  • Fabricate a customer experience;

  • Publish a fraudulent review;

  • Create fake reviews;

  • Impersonate Sell The Job or one of its representatives;

  • Create fake accounts to manipulate ratings;

  • Coordinate fraudulent reviews;

  • Manipulate reviews through deception;

  • Attribute statements to Sell The Job that were not made by Sell The Job; or

  • Disseminate materially false factual information for an unlawful purpose.

Honest Reviews and Protected Communications

NOTHING IN THESE TERMS PROHIBITS AN HONEST REVIEW, TRUTHFUL OPINION, GOOD-FAITH COMPLAINT, OR TRUTHFUL DESCRIPTION OF AN ACTUAL CUSTOMER EXPERIENCE.

Nothing in these Terms prohibits or restricts:

  • Truthful negative reviews;

  • Good-faith criticism;

  • Good-faith consumer complaints;

  • Communications with law enforcement;

  • Communications with governmental agencies;

  • Communications with regulators;

  • Court filings;

  • Legally required disclosures;

  • Truthful testimony;

  • Cooperation with investigations;

  • Responding to subpoenas or legal process; or

  • Any other communication or activity protected by applicable law.

This section is intended to address knowingly false, fraudulent, impersonating, defamatory, manipulated, or otherwise unlawful conduct—not legitimate criticism or legally protected consumer speech.

51. NO CIRCUMVENTION OR MISUSE OF BUSINESS INTRODUCTIONS

Sell The Job may provide customers, suppliers, contractors, resellers, or business partners with access to non-public supplier relationships, service providers, business opportunities, pricing arrangements, systems, or commercial introductions.

You may not misuse confidential information obtained solely through such a relationship for the purpose of intentionally and unlawfully interfering with, misappropriating, or circumventing contractual rights belonging to Sell The Job.

This section does not prohibit:

  • Lawful competition;

  • Independently established business relationships;

  • Relationships developed without misuse of Sell The Job confidential information;

  • Use of publicly available information; or

  • Conduct otherwise protected by applicable law.

Where a separately executed reseller, referral, supplier, non-circumvention, confidentiality, or other business agreement contains more specific obligations, the applicable terms of that separate agreement control.

52. THIRD-PARTY INTELLECTUAL PROPERTY

Third-party company names, product names, trademarks, service marks, logos, photographs, videos, content, software, data, and other intellectual property remain the property of their respective owners.

Reference to or sale of a third-party product or service does not transfer ownership of the third party’s intellectual property to the customer or to Sell The Job.

Customers must comply with applicable third-party licenses and intellectual-property rights when using third-party products or services.

53. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a billing error or transaction problem occurred, you are encouraged to contact Sell The Job promptly so the matter can be investigated.

Initiating a chargeback, payment dispute, bank dispute, or processor dispute does not modify:

  • These Terms;

  • The All Sales Final policy;

  • Applicable supplier credit requirements;

  • Applicable documentation requirements;

  • Applicable appointment replacement procedures; or

  • Other contractual obligations.

When a transaction is disputed, Sell The Job may provide relevant transaction evidence to a bank, card issuer, card network, payment processor, payment application, financial institution, or other entity handling the dispute.

Evidence may include:

  • Orders;

  • Invoices;

  • Transaction records;

  • Product descriptions;

  • Applicable Terms;

  • Applicable Terms version;

  • Electronic acceptance records;

  • Checkout records;

  • Refund policies;

  • Supplier credit policies;

  • Delivery records;

  • Shipping records;

  • Download records;

  • Login records;

  • Access records;

  • Communications;

  • Appointment records;

  • Call recordings where lawfully available;

  • Service records;

  • Customization records;

  • Proof of fulfillment; and

  • Other relevant evidence.

Sell The Job may respond to payment disputes and contest chargebacks it reasonably believes are inconsistent with the transaction records or applicable agreement.

Nothing in this section restricts any non-waivable right to dispute a transaction under applicable law, card-network rules, or payment-provider rules.

54. PROHIBITED USE

  • Violate applicable law;

  • Engage in deceptive activity;

  • Impersonate another person or business;

  • Gain unauthorized access to an account or system;

  • Interfere with website or platform security;

  • Circumvent technical restrictions;

  • Introduce malware or malicious code;

  • Falsify appointment outcomes;

  • Misrepresent Sell The Job or its suppliers;

  • Scrape restricted content;

  • Harvest member content without authorization;

  • Engage in other unlawful or materially abusive conduct.

Sell The Job may take reasonable measures to protect its customers, systems, suppliers, intellectual property, and Services from prohibited activity.

55. THIRD-PARTY LINKS AND WEBSITES

SellTheJob.co may contain links to independent websites, suppliers, processors, platforms, or services.

Those third-party websites and services may be governed by their own:

  • Terms of use;

  • Privacy policies;

  • Refund policies;

  • Credit policies;

  • Security practices; and

  • Business practices.

Sell The Job does not control independent third-party websites and is not responsible for their content or practices except to the extent responsibility cannot legally be excluded.

Customers should review applicable third-party terms before using an independent third-party service.

56. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELLTHEJOB.CO, ITS CONTENT, AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR EXPRESS WRITTEN WARRANTIES OR GUARANTEES SPECIFICALLY PROVIDED FOR A PARTICULAR PRODUCT OR SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELL THE JOB DISCLAIMS IMPLIED WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED.

SELL THE JOB DOES NOT WARRANT THAT:

  • The website will always be uninterrupted;

  • Every feature will always remain available;

  • Every third-party service will operate without interruption;

  • Training will produce a particular financial result;

  • An appointment will produce a sale;

  • Third-party data will always be error-free; or

  • Every product will be suitable for every customer’s particular circumstances.

Nothing in these Terms eliminates an express written warranty or guarantee specifically applicable to a purchased product or service.

Nothing excludes a warranty, right, or remedy that applicable law does not permit the parties to exclude.

57. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, J & J Investments of Florida LLC d/b/a Sell The Job and its applicable owners, officers, employees, agents, contractors, and affiliates shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to:

  • Third-party data;

  • Supplier conduct; or

  • Customer implementation of educational materials,

except where such limitation is prohibited by law.

To the maximum extent permitted by applicable law, Sell The Job’s aggregate liability arising from a particular purchased product or service shall not exceed the amount actually paid to Sell The Job for the particular product or service giving rise to the claim.

The limitations in this section are intended to apply only to the extent legally enforceable and do not exclude liability that applicable law prohibits from being excluded or limited.

58. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless J & J Investments of Florida LLC d/b/a Sell The Job and its owners, officers, employees, agents, contractors, and affiliates from third-party claims, liabilities, damages, losses, and reasonable costs arising from or relating to:

  • Your unlawful use of the Services;

  • Your material violation of these Terms;

  • Your infringement of third-party rights;

  • Your company’s products or services;

  • Your representatives’ conduct;

  • Unauthorized redistribution of purchased materials;

  • Customer-supplied materials that infringe third-party rights;

  • Your misuse of appointment information;

  • Your performance of regulated activities without required authorization; or

  • Your failure to comply with applicable licensing or regulatory requirements.

This indemnification obligation applies only to the extent permitted by applicable law and does not require indemnification for matters that legally cannot be shifted to the customer.

59. FORCE MAJEURE

To the extent permitted by applicable law, Sell The Job will not be responsible for delays or failures in performance caused by circumstances outside its reasonable control.

Such circumstances may include:

  • Hurricanes;

  • Tropical storms;

  • Floods;

  • Fires;

  • Tornadoes;

  • Severe weather;

  • Natural disasters;

  • War;

  • Terrorism;

  • Civil disturbances;

  • Governmental actions;

  • Regulatory changes;

  • Court orders;

  • Telecommunications outages;

  • Internet outages;

  • Utility failures;

  • Cybersecurity incidents;

  • Platform outages;

  • Hosting failures;

  • Supplier outages or failures;

  • Transportation interruptions;

  • Labor disruptions;

  • Epidemics;

  • Pandemics;

  • Public emergencies; and

  • Other events beyond reasonable control.

Where performance is temporarily prevented by such an event, Sell The Job may resume performance when reasonably practicable.

This provision does not eliminate rights that applicable law does not permit the parties to waive.

60. RELATIONSHIP OF THE PARTIES

Except where a separate written agreement expressly provides otherwise, your purchase or use of Sell The Job Services does not create a:

  • Partnership;

  • Joint venture;

  • Franchise;

  • Employment relationship;

  • Fiduciary relationship;

  • General agency relationship; or

  • Authority for either party to legally bind the other.

A customer purchasing Sell The Job Services remains an independent individual or business responsible for its own operations.

Nothing in these Terms authorizes a customer to represent that the customer is an employee, legal representative, partner, or agent of Sell The Job.

61. ASSIGNMENT AND TRANSFER

You may not assign, transfer, sell, sublicense, or otherwise transfer your member account, University access, digital-product license, appointment package, contractual rights, or obligations under these Terms without Sell The Job’s written consent, except where applicable law provides otherwise.

Sell The Job may assign these Terms or related contractual rights and obligations in connection with a legitimate:

  • Merger;

  • Acquisition;

  • Corporate restructuring;

  • Financing;

  • Sale of assets;

  • Sale or transfer of the business;

  • Reorganization; or

  • Similar business transaction,

subject to applicable law.

62. TERMINATION, ACCOUNT CLOSURE, AND EFFECT OF TERMINATION

A customer may stop using SellTheJob.co at any time, but stopping use of the website does not cancel an existing purchase, payment obligation, service agreement, appointment package, or other contractual obligation.

Sell The Job may terminate or restrict future access when reasonably necessary because of:

  • Material violation of these Terms;

  • Fraud;

  • Security threats;

  • Unauthorized account access;

  • Piracy;

  • Intellectual-property infringement;

  • Unlawful conduct;

  • Abuse of the Services; or

  • Other material contractual violations.

Termination for a material customer violation does not create a refund right except where required by applicable law.

Where an account is voluntarily closed without a contractual violation, rights to previously purchased downloadable materials or Services will be determined by the applicable product license, access period, purchase terms, and technical requirements.

Termination does not erase payment obligations or legal rights that arose before termination.

63. SURVIVAL

Provisions that by their nature should continue after termination, expiration, account closure, completion of a transaction, or cessation of website use will survive to the extent legally applicable.

These may include provisions concerning:

  • Outstanding payment obligations;

  • Intellectual-property ownership;

  • Licensing restrictions;

  • Unauthorized copying and redistribution;

  • Confidential information;

  • Chargebacks and payment disputes;

  • Liability limitations;

  • Warranty disclaimers;

  • Indemnification;

  • Governing law;

  • Venue;

  • Enforcement rights;

  • Dispute-related obligations; and

  • Other provisions reasonably intended to survive.

64. GOVERNING LAW, DISPUTE NOTICE, AND VENUE

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before filing a lawsuit concerning a dispute arising directly from a transaction with Sell The Job, the parties are encouraged, where practical, to provide written notice describing the dispute and make a good-faith effort to resolve it informally.

A written dispute notice to Sell The Job may be sent to:

J & J Investments of Florida LLC

Attn: Legal / Dispute Notice

Ormond Beach, FL 32176

Email: Sellthejob.co@gmail.com

Nothing in this informal-resolution provision prevents a party from seeking emergency or injunctive relief where appropriate, complying with a limitations period, pursuing a legally protected administrative remedy, or exercising a right that cannot legally be restricted.

To the extent permitted by applicable law, judicial proceedings arising from these Terms or transactions with Sell The Job shall be brought in a court of competent jurisdiction located in Volusia County, Florida, unless:

  • A separately executed written agreement provides otherwise; or

  • Applicable law requires a different forum.

65. SEVERABILITY, NO WAIVER, ENTIRE AGREEMENT, AND ORDER OF TERMS

Severability

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum lawful extent or severed as necessary.

The remaining provisions will continue in effect.

No Waiver

Failure by Sell The Job to enforce a provision on one occasion does not constitute a permanent waiver of that provision or the right to enforce it later.

A waiver is effective only to the extent actually granted.

Entire Agreement

Depending upon the product or service purchased, the agreement between the parties may include:

  • These Terms;

  • The Sell The Job Privacy Policy;

  • The applicable product description;

  • The applicable invoice or order;

  • A separately executed service agreement;

  • An applicable written guarantee;

  • Applicable supplier terms; and

  • Applicable supplier credit or replacement policies.

For third-party appointment products, applicable supplier qualification, guarantee, credit, documentation, reporting, and replacement provisions govern those specific aspects of the service.

If a separately signed agreement contains a specifically negotiated provision that expressly conflicts with these general Terms concerning the same subject matter, the specifically negotiated provision controls for that transaction to the extent of the conflict.

66. VERSION OF TERMS, CHANGES, AND CONTACT INFORMATION

Version Applicable to a Purchase

The version of these Terms presented or otherwise applicable when an order is accepted generally governs that transaction unless:

  • A separately executed written agreement provides otherwise;

  • The parties subsequently agree in writing to a modification; or

  • Applicable law requires otherwise.

Sell The Job may preserve historical versions of these Terms and records of electronic acceptance.

Future revisions do not retroactively eliminate contractual rights or obligations unless legally permitted and appropriately agreed.

Changes to These Terms

Sell The Job may update these Terms prospectively to reflect changes in:

  • Business operations;

  • Products;

  • Services;

  • Technology;

  • Suppliers;

  • Legal requirements;

  • Security practices; or

  • Other legitimate business needs.

The Last Updated date at the beginning of these Terms identifies the current published version.

Material changes affecting an existing contractual relationship will be handled in accordance with applicable law.
